Expanding the Qualifying Facilities Under the Clean Energy Standard to Include Existing Nuclear and Large Hydroelectric Facilities.

This bill amends the Clean Energy and Energy Efficiency Portfolio Standard to expand the definition of qualifying clean energy facilities to include nuclear energy facilities placed into service on or after January 1, 2007, including uprates, and fusion energy facilities. It also revises the definition of renewable energy facility to remove the prior exclusion of hydroelectric facilities with a generation capacity of more than 10 megawatts, thereby allowing large hydroelectric facilities to qualify under the standard. By broadening eligibility to include existing nuclear generation and large hydroelectric power, the bill recognizes reliable baseload energy sources within the state’s clean energy framework. Expanding qualifying resources increases flexibility within the energy portfolio standard and reduces regulatory pressure to favor only intermittent sources.
