Strengthening Public Safety by Increasing Penalties for Fleeing from Law Enforcement Officers.

This bill increases penalties for fleeing or attempting to elude law enforcement officers. Under the bill, the Offense Severity Ranking for "Driving at high speed or with wanton disregard for safety while fleeing or attempting to elude" is increased from Level 4 to Level 5, and "Aggravated fleeing or eluding" from Level 5 to Level 6. The bill also requires a sentence multiplier for individuals with prior violations for fleeing or attempting to elude. Finally, the bill eliminates the requirement that a law enforcement vehicle be marked with "agency insignia" in order to charge a driver with fleeing or attempting to elude. Protecting property rights and ensuring public safety serve as essential components of government. Unfortunately, this bill is especially necessary due to many so-called criminal justice "reforms" which have led to skyrocketing crime rates and are being advanced in state legislatures by George Soros and other radical-left billionaires through their funding of advocacy organizations on both sides of the political aisle.

Protecting Consumer Choice By Prohibiting Mandates on Energy Sources and Appliances.

This bill prohibits rural electric cooperatives and local entities from enacting rules that restrict or prohibit the fuel sources (like natural gas, propane, etc.) or appliances (such as gas stoves, water heaters, or furnaces) used to provide energy to consumers. Protecting Florida's Ballot Initiative Process by Increasing Protections Against Fraud.

This bill establishes several new protections designed to protect against fraud in the state's citizen-initiated constitutional amendment process. Most notably, the bill requires petition collectors to be U.S. citizens and residents of Florida, requires signers to provide their driver's license number of the last four digits of their social security number, and prohibits collectors from providing forms with pre-filled information. Additionally, a person may not collect more than 25 petitions unless they are registered as a petition collector. Finally, the bill requires the Supervisor of Elections to notify voters whose name and signature appear on a petition, and requires the Office of Election Crimes and Security to investigate a petition's sponsors, circulators, and/or collectors if more than 25% of the signatures are invalid. This measure helps protect the initiative petition process from fraud and abuse by special interests and other groups that seek to grow the size and scope of government.

Growing the Role of Government Through a New Statewide "Waste Reduction and Recycling Plan".

This bill requires the Department of Environmental Protection to establish "a comprehensive waste reduction and recycling plan." Among other requirements are that the plan include statewide recycling education and outreach efforts, local government recycling assistance, and "plans to develop and promote markets for recyclable materials." The private sector is the best equipped to advance recycling efforts, and this measure unnecessarily grows the role of government. As the Governor stated in his veto message, this bill "perpetuates a cycle of plans and reports without action and does not take into consideration that the private sector is continuously implementing innovative ways to reduce waste." The bill would mandate yet another layer of government planning —requiring DEP to convene a technical group, produce reports, and develop multi-year strategies — despite Florida already having established recycling goals and programs under existing statutes.

Promoting Fiscal Responsibility by Increasing the Amount in the Rainy Day Fund and Allowing Limited Withdrawals for "Critical State Needs".

This resolution proposes an amendment to the state Constitution to increase the maximum amount of funds that may be held in the budget stabilization fund (commonly referred to as the "rainy day" fund) from 10% to 25% of the previous year's revenue collections. Hiking Utility Rates to Subsidize More Costly "Renewable" Natural Gas.

This bill allows gas utilities to recover costs for investments in "gas" infrastructure for renewable natural gas (RNG) sources-- such as Anaerobically generated biogas, Landfill gas, or Wastewater treatment gas-- when they have been refined to at least 90% methane content, produced and collected within Florida, and usable as transportation fuel or for pipeline distribution. RNG is at least twice as costly as natural gas. Allowing utility companies to receive guaranteed profits by hiking rates for consumers is unwise, unnecessary, and only a benefit to the utility company.

Expanding Healthcare Options by Authorizing Greater Stem Cell Therapy and Increasing Penalties for Usage of Aborted Fetus Remains.

This bill allows physicians to perform stem cell therapies that are not approved by the U.S. Food and Drug Administration, for purposes of orthopedics, wound care, or pain management. The retrieval and storage of stem cells must meet certain requirements, such as being stored in an accredited facility registered with the FDA. Stem cells may not be obtained from aborted fetuses. Additionally, the bill makes it a third-degree felony to use human cells or tissues obtained from an aborted fetus or embryo in treatment or research, or to sell, manufacture, or distribute computer products created using human cells or tissues.

Strengthening Property Rights by Requiring Localities to Allow Accessory Dwelling Units (ADUs).

With CEA
The House version of this bill (Conerly amendment #063937) requires localities to allow accessory dwelling units (ADUs)-- such as in-law suites and rental units-- in areas zoned for single-family residential use. Previously, this was optional. Localities may regulate ADUs, but may not require property owners to reside in the main residential dwelling or impose certain parking requirements. The bill also provides that property owners may not be denied a homestead exemption solely because of the presence of an ADU that is rented. Finally, the bill requires the Office of Program Policy Analysis and Government Accountability (OPPAGA) to evaluate the use of "mezzanine finance, or second-position short-term debt, to stimulate the construction of owner-occupied" affordable housing, as well as the potential for "tiny homes" to help meet affordable housing needs. While the bill contains a negative provision related to potential government financing of affordable housing, as a whole the bill is a step in the right direction to housing affordability and individual freedom.

Nehemiah assessed the ruins of Jerusalem and called the people to rebuild what had been destroyed. First Freedom faces similar ruins today - religious liberty eroded, conscience protections demolished, believers marginalized in public life. Reducing Wasteful Spending by Eliminating Grants for Environmental Services on Private Property.

This bill repeals the Local Trail Management Grant Program, which provided localities with grants for trail maintenance. The bill also eliminates the authority of the Fish and Wildlife Conservation Commission to use land management funds from the Indian Gaming Revenue Clearing Trust Fund for environmental services on private property. Additionally, the bill repeals the requirement that revenue from the gaming compact between the state and the Seminole Tribe of Florida be used for conservation purposes. Finally, the bill allows the South Florida Water Management District to acquire land for a reservoir project of at least 200,000 acre-feet. Giving Hotel Owners More Power to Remove Problem Guests and Providing More Transparency for Restaurant Patrons.

The bill expands grounds for hotel/motel operators to remove unwanted or unauthorized guests, for reasons including lewd conduct, drug possession, disturbing peace, and non-payment. It allows for law enforcement action if a guest refuses to leave. Giving lodging operators the freedom to conduct their business in an appropriate and safe way is a step toward liberty. This bill also requires restaurants that choose to charge an added "operations charge" to customers' tabs to include a notice on menus, contracts, in apps, and on websites.
